HomiEats Buyer Terms of Use and Marketplace Purchase Terms
Rules for browsing, creating a buyer account and purchasing artisanal food through homieats.ca
Effective date
September 29, 2026
Operator
Hector Torres, carrying on business under the commercial name HomiEats
Territory
Québec, Canada
Publication status Operational draft for Québec legal review. HomiEats is operated by Hector Torres as an individual under the commercial name HomiEats. The complete French version must be published before launch. If the French and another-language version differ, applicable Québec language law governs the user’s rights.
These Terms govern the use of the HomiEats marketplace by visitors and buyers in Québec. HomiEats provides the marketplace and facilitates payment through Stripe Connect. Except where Hector Torres is identified as the producer, the producer or distributor identified on the listing is the merchant and seller of the product.
1 Definitions
1.1 Marketplace parties
“HomiEats,” “we,” “us” and “our” mean Hector Torres, carrying on business under the commercial name HomiEats, at the address stated above. “Buyer” means a person who purchases a product for personal use. “Seller” means the producer or distributor identified on a listing and order confirmation. “Product” means food or another item expressly permitted on the Marketplace. “Marketplace” means homieats.ca and its related transaction functions. “Order” means a purchase submitted through the Marketplace.
1.2 Platform providers
The Marketplace is powered by Sharetribe. Payments and seller payouts are processed through Stripe Connect. Sharetribe and Stripe are independent service providers and may apply their own terms and privacy notices.
2 Eligibility and acceptance
A person may browse the Marketplace without an account. To create an account, place an Order, sell a Product or enter a transaction, the person must be at least 18 years old and legally capable of contracting. A person acting for an organization confirms that they have authority to bind it.
Acceptance must be recorded through the Marketplace’s checkbox or other affirmative electronic mechanism. The French version must be made available before a Québec user is asked to accept another-language version. Use of the Marketplace is also subject to the HomiEats Privacy Policy and, where applicable, the Refund Cancellation and Food Safety Policy.
3 Role of HomiEats and identity of the Seller
HomiEats operates a marketplace that allows independent producers and distributors to list and sell Products. The Seller identified on the listing and Order confirmation is the merchant responsible for the Product, its description, legal compliance, preparation, labelling, taxes, pickup or delivery and after-sale obligations.
When a listing identifies Hector Torres or Chef Torres as the producer or Seller, Hector Torres is the merchant for that Order. Chef Torres is a commercial name only and does not identify a separate legal entity.
HomiEats verifies seller information and required MAPAQ authorization before activation, but that verification does not transfer the Seller’s legal obligations to HomiEats or guarantee that circumstances will never change.
4 Accounts and acceptable use
Users must provide accurate, complete and current information; protect their login credentials; and promptly report suspected unauthorized access. HomiEats may request identity, address or transaction information reasonably required for fraud prevention, legal compliance or payment processing.
Users must not impersonate another person; interfere with the Marketplace; upload malicious code; scrape or copy protected content; evade Marketplace fees; create fraudulent transactions; manipulate reviews; harass another user; or use the Marketplace for unlawful purposes.
5 Product information and food allergies
The Seller is responsible for keeping each listing accurate and current, including the Product identity, price, quantity, ingredients, allergens, storage requirements, preparation or reheating instructions, availability and applicable pickup or delivery options.
Buyers must review the listing, physical label and instructions before consuming or serving a Product. A Buyer with a food allergy, intolerance or special dietary requirement should contact the Seller before ordering and must not rely on filters, photographs or informal descriptions alone. Nothing in this section reduces a Seller’s legal duty to disclose ingredients and allergens accurately.
6 Orders and distance contracts
Before submitting an Order, the Buyer will be given an opportunity to review and correct the Order. The checkout flow must disclose the Seller’s identity and contact information, Product description and quantity, currency, price, applicable taxes, HomiEats Buyer Fee, delivery charge, total amount, fulfilment method, anticipated timing and the applicable cancellation or refund conditions.
An Order is subject to acceptance by the Seller. An automated acknowledgement does not guarantee acceptance or availability. Once accepted, an electronic confirmation that the Buyer can save or print will be provided. Mandatory rights applicable to distance contracts under Québec law remain fully available.
7 Prices fees taxes and payment
All amounts are stated in Canadian dollars unless clearly indicated otherwise. The Buyer pays the Product price, applicable taxes, any Seller-set delivery charge and a HomiEats Buyer Fee equal to 10% of the applicable transaction amount shown at checkout. The complete total will be shown before the Buyer confirms payment.
Stripe processes the payment through Stripe Connect. The Seller is the merchant identified for the Product and on the transaction record. HomiEats receives its commission through the Marketplace payment flow and does not independently store full payment-card details. Authorization, fraud screening, refunds and payment delays may be subject to Stripe’s systems and terms.
8 Pickup and delivery
Each Seller determines whether a Product is available for pickup, delivery or both, as well as the available area, schedule and delivery fee. Those terms form part of the Order.
The Buyer must provide accurate contact and delivery information, be available during the agreed window and follow food-storage instructions promptly. The Seller remains responsible for safe preparation, packaging and handling until proper pickup or delivery. Risk does not transfer to the Buyer before proper fulfilment, and no clause limits mandatory rights relating to an unsafe, defective, misdescribed or improperly delivered Product.
9 Cancellations refunds and disputes
The HomiEats Refund Cancellation and Food Safety Policy forms part of these Terms. Because Products may be perishable or prepared for a specific Order, change-of-mind cancellation may be limited after acceptance or preparation begins. This does not limit statutory cancellation, refund, legal-warranty or chargeback rights.
A Buyer who receives an incorrect, missing, damaged, thawed, contaminated, unsafe or materially misdescribed Product should promptly use the Marketplace dispute function and contact info@homieats.ca before confirming receipt. The Buyer should keep the Product, packaging, labels, receipt and photographs when safe to do so.
Sharetribe’s standard Stripe transaction process generally supports a full transaction refund rather than a partial refund. The available remedy and workflow depend on transaction status and applicable law. HomiEats may facilitate communication and apply platform transitions, but the Seller remains responsible for its legal obligations.
10 Reviews content and communications
Reviews must reflect a genuine experience and must not be false, purchased, coercive or misleading. A user must clearly disclose any gift, discount, family relationship, business connection or other material connection that could affect how a review is understood. HomiEats may remove content that violates these Terms, while preserving lawful criticism and consumer rights.
By submitting content, the user grants HomiEats a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, display and promote that content for operating and marketing the Marketplace, subject to privacy law. The user retains ownership and confirms having the necessary rights.
Transactional messages may be sent as needed to operate an account or Order. Promotional emails about products, producers and offers will be sent only where HomiEats has a valid consent or another lawful basis. Each commercial message will identify the sender and provide a working unsubscribe method. Unsubscribe requests do not prevent necessary transactional messages.
11 Intellectual property
The Marketplace design, HomiEats name, graphics and original platform content belong to Hector Torres or the applicable licensor. No right is granted except the limited right to use the Marketplace in accordance with these Terms. Sellers retain rights in their own brands and listing content, subject to the licence necessary to operate and promote the Marketplace.
12 Suspension termination and changes
HomiEats may suspend or restrict an account or listing where reasonably necessary for food safety, fraud prevention, legal compliance, non-payment, misuse, investigation or a material breach. Where appropriate, HomiEats will provide notice and a reasonable opportunity to respond. Pending Orders, refunds, chargebacks and legal obligations survive suspension or closure.
Material amendments will be communicated in a manner appropriate to their significance. Changes will not retroactively remove accrued rights. Where renewed consent is legally required, continued use alone will not replace that consent.
13 Warranties and responsibility
The Marketplace technology is provided on an “as available” basis, subject to mandatory law. HomiEats does not promise uninterrupted operation or that every Seller will remain continuously available. Each Seller is responsible for its Products and representations.
Nothing in these Terms excludes or limits legal warranties, consumer rights, liability for bodily or moral injury, intentional or gross fault, or any other obligation that cannot legally be excluded or limited. Subject to those mandatory rights, HomiEats is responsible only for direct loss caused by its own proven fault in operating the Marketplace.
14 Governing law and disputes
These Terms are governed by the laws of Québec and the federal laws of Canada applicable in Québec. A Québec consumer retains the jurisdiction and protections granted by mandatory law. Before commencing a proceeding, the parties are encouraged to contact one another and attempt a good-faith resolution, but this does not suspend a limitation period or restrict access to a regulator, chargeback or court remedy.
15 Language
The French version of these Terms will be provided before a Québec user expressly chooses to contract in another language. Nothing in these Terms makes the English version prevail over rights granted under Québec language law. If versions differ, the user may rely on the version available to them to the extent permitted by applicable law.
16 Contact and legal notices
HomiEats may be contacted at info@homieats.ca, 514-512-8597, or 1692 rue St-Gérald, Longueuil, Québec J4P 2E4. HomiEats is operated by Hector Torres as an individual and does not currently have a Québec enterprise number. Notices concerning an Order should include the Order number and the email used for the account. HomiEats Seller and Distributor Agreement
Operating rules for producers and distributors listing artisanal food on the HomiEats marketplace
This Agreement governs the relationship between HomiEats and each producer or distributor that lists or sells Products through the Marketplace. Its purpose is to assign clear responsibility for permits, food safety, listings, fulfilment, payment, refunds and customer service.
1 Parties and acceptance
This Agreement is between Hector Torres, carrying on business under the commercial name HomiEats, and the person or business accepted as a seller account holder (“Seller”). A “Producer” prepares or manufactures a Product. A “Distributor” purchases a Product from a producer and resells it in its own name. A Distributor is the Seller and merchant for its resale Orders.
The individual accepting this Agreement must be at least 18 years old and authorized to bind the Seller. Electronic acceptance is effective when recorded by the Marketplace. The complete French version must be presented first where required by Québec law.
2 Seller onboarding and continuing eligibility
Before activation and throughout participation, the Seller must provide accurate legal identity, address, contact, banking, tax and ownership information; complete Stripe Connect verification; and provide every permit, certificate or document requested by HomiEats.
Every Producer and Distributor must hold all MAPAQ permits and food-hygiene or safety qualifications legally required for its activities, location, food category and method of preparation, storage, transport, sale or resale. HomiEats verifies documents before activation, but the Seller alone remains responsible for determining and maintaining all requirements.
The Seller must immediately notify HomiEats of an expiry, suspension, restriction, inspection issue, warning, investigation, recall or material change affecting its authorization or ability to sell safely. HomiEats may reverify eligibility at any time.
3 Independent business status
The Seller operates an independent business and is not an employee, partner, franchisee, representative or agent of HomiEats. The Seller controls its Products, schedule, inventory, permitted fulfilment methods and lawful pricing, subject to this Agreement and Marketplace functionality.
The Seller may not bind HomiEats, make warranties on its behalf or represent that HomiEats manufactured, inspected or guaranteed a Product. When Hector Torres sells a Chef Torres Product, he acts as that Product’s Seller in addition to operating the Marketplace.
4 Product and listing standards
Each listing must be truthful, complete, current and supported by the Seller’s records. It must accurately state, as applicable, the Product name, producer, origin, quantity, price, taxes, ingredients, priority allergens, gluten sources, cross-contamination warnings that are factually justified, storage temperature, frozen status, preparation or reheating instructions, durable-life information, availability and fulfilment options.
The Seller must comply with all federal and Québec requirements governing food composition, packaging, bilingual labelling, nutrition information, claims, weights and measures, traceability and advertising. Health, organic, local-origin, “homemade,” “artisan,” allergen-free or similar claims may be used only when accurate and legally supportable.
The Seller must not list recalled, expired, adulterated, contaminated, counterfeit or unsafe Products; Products made or stored at an unauthorized location; or alcohol, cannabis, controlled substances or another restricted item unless HomiEats has expressly authorized the category and all legal requirements are satisfied.
5 Food safety preparation and traceability
The Seller is solely responsible for hygienic preparation, approved sourcing, prevention of cross-contamination, temperature control, packaging, storage, transportation, employee or helper training and all records required by law.
The Seller must maintain records reasonably sufficient to identify the source, production or lot information and purchasers of affected Products and must preserve them for the period required by law. The Seller must cooperate promptly with HomiEats, MAPAQ, the Canadian Food Inspection Agency, public-health authorities and payment providers in any investigation or recall.
6 Orders fulfilment and customer service
The Seller determines whether it offers pickup, delivery or both and must disclose the applicable location or area, timing, conditions and extra delivery fee before purchase. The Seller must accept or reject Orders promptly, keep inventory current and fulfil accepted Orders according to the listing and confirmation.
The Seller remains responsible for the Product and safe handling until proper pickup or delivery. It must use suitable packaging, maintain required temperatures, provide the physical label and instructions, and respond promptly and professionally to Buyer questions or complaints.
The Seller may not direct a Buyer to complete a Marketplace-originated transaction off-platform for the purpose of avoiding fees, safeguards or records.
7 Marketplace fees taxes and pricing
HomiEats charges the Seller a commission equal to 10% of the applicable transaction amount disclosed through the Marketplace. HomiEats separately charges the Buyer a 10% Buyer Fee. The Seller may set a delivery charge, which must be disclosed before checkout. No fee may be hidden from the Buyer.
The Seller is responsible for setting lawful prices and determining, registering for, collecting, reporting and remitting GST, QST and other taxes applicable to its sales, except to the extent HomiEats is legally required to collect or remit a particular amount. The Seller must provide accurate tax information and invoices where required.
8 Stripe Connect payments and payouts
Payments are processed through Stripe Connect within the Sharetribe transaction process. The Seller must complete and maintain its Stripe connected account and accept Stripe’s applicable connected-account terms. Stripe may conduct identity, sanctions, fraud and banking verification.
Subject to both parties confirming delivery and receipt, the Marketplace will ordinarily trigger or schedule the Seller payout within 24 to 48 hours. This is an operational target, not a guarantee that funds will reach the Seller’s bank within that period. Stripe processing, weekends, bank delays, reserves, verification, disputes, refunds, chargebacks, negative balances and legal holds may delay or reverse payment.
The Seller authorizes HomiEats and Stripe to deduct commissions, refunds, chargebacks, reversals and other amounts properly owing under this Agreement from transaction proceeds or future payouts. The Seller must not issue a manual Stripe refund outside the Marketplace workflow without HomiEats’ written instructions.
9 Cancellations refunds complaints and chargebacks
The Seller must publish and follow cancellation conditions consistent with the HomiEats Refund Cancellation and Food Safety Policy and mandatory law. A Seller cancellation ordinarily results in a full refund to the Buyer, including Marketplace fees, through the available Sharetribe workflow.
The Seller is financially responsible for refunds, chargebacks, recalls or claims caused by its Product, listing, cancellation, non-fulfilment, unsafe handling, legal non-compliance or breach. HomiEats may investigate, facilitate communication, preserve evidence and select the appropriate platform transition, without assuming the Seller’s underlying legal responsibility.
Because the standard Sharetribe Stripe integration normally supports full rather than partial transaction refunds, the Seller must not promise a partial platform refund unless HomiEats confirms that the functionality is available for that transaction.
10 Distributors
A Distributor purchases Products for resale and acts as the Seller and merchant to the Buyer. The Distributor must have lawful title or authorization to resell, maintain traceability to the Producer, preserve original safety and label information, comply with storage and temperature requirements and hold every MAPAQ permit required for retail sale, handling, portioning, repackaging or preparation.
A Distributor may not alter labels, ingredients, best-before information or the Product without lawful authority and updated compliant information. The Distributor and Producer must clearly allocate recall, refund, supply and indemnification responsibilities between themselves; their private arrangement does not reduce either party’s obligations to Buyers, HomiEats or regulators.
11 Insurance and risk management
HomiEats strongly recommends that every Seller maintain commercial general liability and product-liability insurance appropriate to its Products and sales volume. Insurance is not currently a condition of activation. The absence of insurance does not limit the Seller’s liability or transfer risk to HomiEats.
HomiEats may introduce a prospective insurance requirement on reasonable advance notice where justified by risk, law, payment-provider requirements or product category. Any such change will not retroactively alter completed transactions.
12 Reviews marketing and electronic messages
The Seller must not create, purchase, arrange or suppress reviews deceptively, condition service on a positive review or retaliate for an honest review. Any incentive or material connection must be clearly disclosed.
The Seller grants HomiEats a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, translate, display and promote its listing content and trademarks for Marketplace operation and marketing. The Seller retains ownership and warrants that the content is accurate and non-infringing.
The Seller may send commercial electronic messages to Buyers only where it has independent lawful authority and complies with Canadian anti-spam requirements. Marketplace access does not give the Seller unrestricted permission to export or market to Buyer contact information.
13 Privacy and confidential information
The Seller may use Buyer personal information only to fulfil the Order, provide legally required after-sale service, manage safety or recalls, and comply with law. It must protect the information, restrict access, report a suspected breach promptly and securely delete or retain it according to legal requirements. The HomiEats Privacy Policy governs HomiEats’ own processing.
14 Monitoring suspension and termination
HomiEats may remove a listing or immediately suspend a Seller where reasonably necessary to address suspected food-safety risk, missing or invalid permits, fraud, unlawful content, payment risk, repeated non-fulfilment, serious complaints or regulator instructions. HomiEats may request corrective action and supporting records before reinstatement.
Either party may end participation on reasonable notice, subject to pending Orders, payouts, refunds, chargebacks, investigations, recalls and accrued obligations. HomiEats will not withhold undisputed funds except as permitted by this Agreement, the transaction process, payment-provider rules or law.
15 Responsibility indemnification and legal limits
The Seller is responsible for losses, claims, recalls, penalties and reasonable costs arising from its Products, listings, taxes, fulfilment, privacy practices, infringement or breach of this Agreement. To the extent permitted by law, the Seller will indemnify HomiEats and Hector Torres against third-party claims attributable to those matters, except to the extent caused by HomiEats’ own fault.
Nothing excludes liability that cannot legally be excluded, including intentional or gross fault and applicable liability for bodily or moral injury. HomiEats does not guarantee uninterrupted technology or Buyer demand and is liable only for direct loss caused by its own proven fault, subject to mandatory law.
16 Governing law language and general provisions
This Agreement is governed by Québec law and the federal laws of Canada applicable in Québec. The parties should first attempt good-faith resolution, without restricting urgent relief, regulatory rights or limitation periods.
The French version will be presented before a Seller expressly chooses another language where required. If versions differ, applicable Québec language law governs. The Seller may not assign this Agreement without HomiEats’ written consent. Invalid provisions will be adjusted only as necessary, and the balance remains effective. Provisions concerning payments, taxes, food safety, recalls, privacy, intellectual property, liability and disputes survive termination.
17 Contact and notices
Notices to HomiEats may be sent to info@homieats.ca or 1692 rue St-Gérald, Longueuil, Québec J4P 2E4. Telephone: 514-512-8597. HomiEats is operated by Hector Torres as an individual and does not currently have a Québec enterprise number. The Seller must keep its notice details current in its account. 1 Scope and mandatory rights
This Policy applies to Orders placed through HomiEats in Québec. It does not remove legal warranties or statutory cancellation, refund, delivery, chargeback or damage rights. A deadline in this Policy is intended to permit fast investigation and does not extinguish a right that cannot legally be waived.
2 Before Seller acceptance
If the Marketplace permits the Buyer to withdraw an Order before Seller acceptance, the Buyer should use that function promptly. Any authorization release or refund timing remains subject to Stripe and the Buyer’s financial institution. An acknowledgement of submission is not necessarily Seller acceptance.
3 Seller cancellation or non-fulfilment
If the Seller cannot fulfil an accepted Order, it must notify the Buyer and HomiEats promptly and initiate the available cancellation process. A Seller cancellation ordinarily triggers a full refund through Stripe, including the HomiEats fees charged on that transaction. The Seller must not substitute another Product without the Buyer’s informed agreement.
If delivery or pickup cannot occur within the promised period, the parties may agree to a new time. The Buyer retains all mandatory cancellation rights, including those applicable to distance contracts and delayed performance.
4 Buyer change of mind
Food may be perishable, customized or prepared specifically for an Order. After Seller acceptance or after preparation has begun, a change-of-mind cancellation is not guaranteed. The Buyer should contact the Seller immediately. The Seller’s disclosed cancellation terms apply only to the extent consistent with mandatory law.
A refusal to accept a change-of-mind cancellation does not affect rights relating to an unsafe, defective, mislabelled, incorrect, missing or materially misdescribed Product.
5 Pickup and delivery problems
The Buyer should inspect the Order as soon as reasonably possible. If there is a problem, the Buyer should not confirm receipt or completion in the Marketplace and should report it through the transaction page and to info@homieats.ca.
For an incorrect, missing, damaged, thawed, spoiled, unsafe or materially misdescribed Product, the Buyer should report the issue as soon as possible and preferably within 24 hours of pickup or delivery. The report should include the Order number, description, photographs, label and temperature or storage information where relevant.
When safe, the Buyer should retain the Product, packaging and label until instructed otherwise. A Buyer must not consume a Product suspected to be unsafe merely to establish a claim.
6 Suspected foodborne illness or serious allergen event
The Buyer should seek urgent medical assistance where symptoms are serious or rapidly developing. The Buyer should preserve the Product, packaging, label, receipt, photographs and relevant medical or purchase information, if safe to do so.
The Buyer should notify HomiEats and the Seller promptly. HomiEats may suspend the listing, preserve transaction information, contact other affected Buyers and share necessary information with MAPAQ, public-health authorities, the Canadian Food Inspection Agency, Stripe, insurers or legal advisers as permitted or required by law.
A person may also contact MAPAQ directly regarding suspected food poisoning, contamination, foreign material, labelling or hygiene concerns. HomiEats cooperation does not replace medical care or a report to public authorities.
7 Investigation and resolution
HomiEats may request photographs, communications, labels, proof of pickup or delivery, temperature records, ingredient records and other reasonably relevant information. Buyer and Seller must cooperate honestly and preserve evidence.
Possible outcomes include cancellation and full refund through the Marketplace, rejection of an unsupported claim, replacement by agreement where lawful and safe, a separate commercial accommodation, listing suspension, corrective action or referral to a regulator. No outcome limits mandatory legal remedies.
The Seller remains responsible for its Product and legal obligations. HomiEats facilitates the Marketplace process and may decide which platform transition to use based on available evidence, transaction status and law.
8 Refund mechanics and timing
Sharetribe’s standard Stripe integration generally supports full refunds, including Marketplace commission, rather than partial platform refunds. A transaction can normally be cancelled and refunded only while the applicable transaction process still permits cancellation. Buyers should therefore report problems before confirming receipt or completion.
When a refund is approved, HomiEats will initiate the available Stripe refund without unreasonable delay. The time for the credit to appear depends on Stripe, the payment method and the Buyer’s financial institution. Any statutory refund deadline applies despite this operational explanation.
Stripe processing fees may not be returned to the platform, but this does not authorize deduction from a consumer refund where full reimbursement is legally required or has been approved.
9 Chargebacks
A Buyer should first contact HomiEats so the issue can be investigated promptly, unless urgency or law justifies another step. This request does not restrict a statutory credit-card chargeback or other remedy. A Seller must cooperate with evidence needed to respond to a chargeback and is responsible where the chargeback results from its breach, cancellation, non-fulfilment or Product.
10 Recalls and safety notices
A Seller that becomes aware of an actual or potential recall, undeclared allergen, contamination, labelling error or other material safety risk must immediately stop sales and notify HomiEats with affected Product and lot information.
HomiEats may remove listings, suspend Orders, identify affected transactions and notify Buyers. Buyers must stop consuming the Product and follow disposal, return or refund instructions. The Seller or responsible producer bears recall and refund costs attributable to its Product, subject to applicable law and agreements between producers and distributors.
11 Abuse and false claims
Fraudulent refund claims, fabricated evidence, threats or repeated misuse may result in account restriction and referral to Stripe or appropriate authorities. This provision will not be used to penalize a Buyer for making an honest complaint, leaving a lawful review or exercising a consumer right.
12 Contact
Order and safety reports may be sent to info@homieats.ca. Include the Order number and account email. HomiEats may also be reached at 514-512-8597 or 1692 rue St-Gérald, Longueuil, Québec J4P 2E4. For emergencies, contact the appropriate emergency or public-health service first.
